If you own \u2014 or are considering buying \u2014 a holiday let in Wales, it\u2019s essential to stay up to date with the latest legislation.<\/p>\n<p><strong><em>Here\u2019s a breakdown of some of the new rules for holiday lets in Wales&#8230;<\/em><\/strong><\/p>\n<hr \/>\n<h2 data-start=\"881\" data-end=\"933\">Business Rates vs Council Tax: The New Criteria<\/h2>\n<p data-start=\"1091\" data-end=\"1421\">Since 1 April 2023, holiday lets in Wales that are genuinely run as commercial self-catering businesses must meet stricter criteria to be assessed for business rates rather than council tax. If a property doesn\u2019t meet them, it will instead be liable for <strong data-start=\"2726\" data-end=\"2741\">council tax<\/strong>, which in many areas includes <em data-start=\"2772\" data-end=\"641\">Conwy:<\/strong> 150% premium \u2014 currently in effect.<\/li>\n<li data-start=\"479\" data-end=\"557\"><strong data-start=\"682\" data-end=\"699\">Denbighshire:<\/strong> 150% premium \u2014 currently in effect.<\/li>\n<li data-start=\"479\" data-end=\"557\"><strong data-start=\"740\" data-end=\"755\">Flintshire:<\/strong>100% premium<\/li>\n<\/ul>\n<p data-start=\"1388\" Council introduced an Article\u202f4 Direction on 1\u202fSeptember\u202f2024<\/strong> to manage the use of dwellings as second homes or short\u2011term holiday lets outside the Eryri National Park boundary.<\/p>\n<h4 data-start=\"446\" data-end=\"481\"><strong data-start=\"451\" data-end=\"481\">What this meant originally<\/strong><\/h4>\n<p>The Article\u202f4 Direction removed certain <em data-start=\"522\" data-end=\"552\">permitted development rights<\/em> in the Gwynedd Local Planning Authority area, meaning planning permission <em data-start=\"627\" data-end=\"641\">was required<\/em> for changes of use between the new planning use classes:<\/p>\n<ul>\n<li><strong data-start=\"703\" data-end=\"715\">Class\u202fC3<\/strong> \u2013 main or sole residence (primary home)<\/li>\n<li><strong data-start=\"760\" data-end=\"772\">Class\u202fC5<\/strong> \u2013 second home (non\u2011main residence)<\/li>\n<li><strong data-start=\"812\" data-end=\"824\">Class\u202fC6<\/strong> \u2013 short\u2011term holiday accommodation (holiday let)<\/li>\n<\/ul>\n<p data-start=\"913\" data-end=\"970\">Under the Direction, planning permission <strong>was<\/strong> needed to:<\/p>\n<ul>\n<li data-start=\"973\" data-end=\"1083\">Convert a main residence (C3) into a second home (C5), a short\u2011term holiday let (C6), or certain mixed uses.<\/li>\n<li data-start=\"973\" data-end=\"1083\">Change a second home into a short\u2011term holiday let, or vice versa.<\/li>\n<li data-start=\"973\" data-end=\"1083\">Change between second home and holiday let uses.<\/li>\n<\/ul>\n<p data-start=\"1245\" data-end=\"1475\">The Article\u202f4 Direction was <em data-start=\"1273\" data-end=\"1292\">not retrospective<\/em>, so properties already in these use classes before 1\u202fSeptember\u202f2024 didn\u2019t need retrospective planning permission just to carry on the same use.<\/p>\n<div style=\"border-left: 5px solid #185ea2; background-color: #e9f2fa; padding: 15px 20px; margin: 20px 0; border-radius: 8px;\">\n<p style=\"margin: 0;\"><strong><br \/>\n\u2139\ufe0f Status &amp; legal challenge and updated status of Article 4 (as of February 2026)<\/strong><\/p>\n<p data-start=\"75\" data-end=\"766\">Gwynedd Council\u2019s Article\u202f4 Direction, which would have required planning permission to convert homes into second homes or short-term holiday lets outside Eryri National Park, was quashed by the High Court in late 2025. An appeal attempt by the council was recently refused (February 2026), so the Direction is no longer in force.<\/p>\n<p data-start=\"75\" data-end=\"766\">This means that at present, buyers or investors in Gwynedd (outside Eryri) do not need planning permission for changes of use between main residences, second homes, or holiday lets.
